These terms are an agreement between you and Talos Operations LLC ("Talos", "we", "us") about your use of Fee Simple. By creating an account or using the app, you agree to them. If you do not agree, do not use Fee Simple.
1. Who may use Fee Simple
You must be at least 18. If you use Fee Simple for a company or firm, you confirm that you are allowed to accept these terms for it, and "you" means both you and that organization.
2. Your account
- Sign up with an email address that is yours, and keep it current.
- An account is for one person. Do not share your sign-in.
- You are responsible for what is done through your account. Tell us promptly if you think someone else has used it.
3. Early access
Fee Simple is in early access and is free to use for now. It has usage limits, and we may change, limit, pause or end the service or any part of it at any time. If we begin to charge for it, we will tell you first, and you will owe nothing unless you agree.
4. Acceptable use
You agree not to:
- use Fee Simple for anything unlawful, or to harass, stalk or harm anyone;
- try to see, reach or interfere with another account's work, or with the systems behind the service;
- get around usage limits, or drive the service with automated tools beyond ordinary use;
- resell or republish the service itself, or offer it to others as your own;
- upload anything you have no right to upload, or anything that contains malicious code.
You are responsible for how you use the records you obtain, including any laws on debt collection, privacy and solicitation that apply to you.
5. What the records are, and are not
- Fee Simple retrieves public county records, such as tax cards and recorded deeds, as the county publishes them. We do not alter them.
- County records can be incomplete, out of date or wrong at the source, and a county website can be unavailable or change without notice. We do not guarantee that any record is accurate, current or complete, or that every lookup will succeed.
- Fee Simple is not a title search, a title opinion, an abstract of title or title insurance.
- Talos is not a law firm, and nothing in Fee Simple is legal advice.
- Check a record against its source before you rely on it for anything that matters.
6. Your content
The addresses and files you submit remain yours. You give us permission to use them only as needed to run the service for you. How we handle information is described in our Privacy Policy.
7. Our service
The Fee Simple software, its design and the Talos and Fee Simple names belong to Talos. These terms give you a personal, non-transferable right to use the service while they are in effect, and nothing more.
8. Suspension and closing an account
You may stop using Fee Simple at any time, and you may ask us to close your account. We may suspend or close an account that breaks these terms, puts the service or other people at risk, or has not been used for a long time.
9. No warranties
Fee Simple is provided "as is" and "as available". To the fullest extent the law allows, Talos disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
10. Limit of liability
To the fullest extent the law allows, Talos is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption, arising from your use of Fee Simple or from any record obtained through it. Our total liability for any claim relating to Fee Simple is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
11. Your responsibility to us
If someone brings a claim against Talos because of how you used Fee Simple or the records you obtained through it, or because you broke these terms, you agree to cover the reasonable costs that result.
12. Governing law
These terms are governed by the laws of the state in which Talos Operations LLC is organized, without regard to its conflict-of-laws rules.
13. Changes to these terms
We may update these terms. When we do, we will change the date at the top of this page, and if a change is significant we will tell you in the app or by email. Continuing to use Fee Simple after a change means you accept it.
